In the state of Maryland, there are two labels for drunk driving, and each carries its own consequences. Driving with a blood alcohol level of .08 or higher is considered driving under the influence, or DUI. Driving with a blood alcohol level of .07 or higher is considered driving while impaired, or DWI.
First time offenders who are guilty of a DUI in the state of Maryland will pay up to $1,000 in fines. Jail time is also possible, with one year being the maximum penalty. A qualified DUI lawyer may be able to lessen the penalties, and first time offenders may be able to get probation in place of jail time. A DUI offense is worth 12 points on the driver’s license.
DWI is a lesser offense in Maryland and brings up to $500 in fines. DWI offenders may also spend time in jail, with a maximum sentence of two months. DWI convictions bring 8 points on the driving record.
Both DUI and DWI offenders will lose their licenses. The minimum license suspension is 45 days, but this can be up to 60 days. You can argue for your right to keep your license, but only if you request the hearing within 10 days of your arrest, so talk to your lawyer about how to make this request correctly.
